This privacy policy (“Policy”) applies to the Services operated by Rectify Electronics ("rectify", “we” or “us”)  and our website located at www.Rectify-Electronics.com (the “Service”). The Policy is designed to tell you how we collect and use personally identifying information (“personal info") so you can make an informed decision about using our Service. Please read this statement before using our Service or submitting any info to us. By using our Service, you represent that you are 17 years old or older and you consent to the information collection and use practices described herein. We reserve the right to change the provisions of this privacy policy at any time by posting a revised privacy policy on the Site and indicating on the privacy policy the date it was last updated. Your use of the Service following the posting of such changes or revised statement shall constitute your acceptance of any such changes. We encourage you to review our privacy policy whenever you use our Service to determine if any changes have been made and to make sure that you understand how any infoyou provide will be used.

 

We endeavor to secure your personal information from unauthorized access, use or disclosure by putting into place physical, electronic and managerial procedures to safeguard the information we collect. Credit card information is encrypted during transmission and payment processing is performed by a PCI compliant third party processor and such information is not processed or retained by Rectify Electronics. Other account information is accessible online only through the use of a password and data fields calling for personally identifying information are encrypted when in storage and in transmission. Please be aware, however, no security measures are perfect or impenetrable. To protect the confidentiality of your personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Service by any person using your password. Please advise us immediately if you believe your password has been misused. You should also note that email is not secure, and you should not send any confidential or sensitive information to us via an unsecured email.

 

We  may disclose personal information when we are required to in order to comply with the law (e.g., a lawful subpoena, warrant or court order); to enforce or apply this privacy policy or our other policies or agreements; to initiate, render, bill, and collect for amounts owed to us; to protect our or our customers’ rights, property or safety; to protect our customers from fraudulent, abusive, or unlawful use of our Service; or if we believe that an emergency involving the danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of personal information. We do not sell, share, or rent any info to others in anyway.

Arbitration 

Any controversy or claim shall be settled by arbitration administered by Rectify Electronics under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered and enforced by any court having jurisdiction.

 

The parties agree that any claim or dispute between them or against any agent, employee, successor, or assign of the other, whether related to this agreement or otherwise, and any claim or dispute related to this agreement or the relationship or duties contemplated under this contract, including the validity of this arbitration clause, shall be resolved by binding arbitration  under the procedure then in effect. Any award of the arbitrator(s) may be entered as a judgment in any court having jurisdiction.

 

Any controversy or claim arising out of or relating to a Purchase Agreement or the breach thereof shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Any controversy or claim subject to this arbitration provision shall be decided by one arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

All claims shall be submitted not later than one year after the date on which the person knew, or through reasonable diligence should have known, of the facts giving rise to the claim(s). The failure  to initiate arbitration within the one-year time limit shall constitute a waiver with respect to that dispute. 

SEVERABILITY: If any term of this Agreement is invalid or unenforceable under any statute, regulation, ordinance, executive order or other rule of law, such term shall be deemed reformed or deleted, but only to the extent necessary to comply with such statute, regulation, ordinance, order or rule and the remaining provisions of this order shall remain in full force and effect.

General Warranty and Terms of Service

We try to ensure that the availability and delivery of our Website and its Content is uninterrupted and error-free. However, we cannot guarantee that your access will not be suspended or restricted from time to time, including to allow for repairs, maintenance or updates, although, of course, we will try to limit the frequency and duration of suspension or restriction. To the fullest extent permitted by law, we will be not be liable to you for damages or refunds, or for any other recourse, should our Website or its Content become unavailable or access to the them becomes slow or incomplete due to any reason, such as system back-up procedures, internet traffic volume, upgrades, overload of requests to the servers, general network failures or delays, or any other cause which may from time to time make our Website or its Content inaccessible to you.

You agree that you will not use our Website or its Conduct in any way that causes or is likely to cause the Website, Content, or access to them to be interrupted, damaged or impaired in any way. You understand that you are solely responsible for all electronic communications and content sent from your computer to this Website and its Content and to us.

 

You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so or for whom you have obtained the express consent to provide their name, address, method of payment, credit card number, and billing information.

 

You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Website or its Content. You agree to use the Website and its Content for legitimate, non-commercial purposes only and not for speculative, false, fraudulent, or illegal purposes.

Delinquent accounts will not receive service, shall be charged reasonable service fees, and may be subject to cancellation, without refund at company's discretion.

Data loss/ Data loss prevention; please back up your data, we are not responsible for lost, missing, or the cost of replacing the data; even if we set up the data back up for you.

Abandoned property; materials left in the possession of the company for more than thirty days will become property of the company, and may be sold to recover the costs of storing abandoned property orr/and servicing the property.

 

Hardware/Software purchases  must be paid for prior to installation.

 

RETURNS

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

To complete your return, we require a receipt or proof of purchase.

Non-returnable items:
* Gift cards
* Downloadable software products
* Some health and personal care items

* CD, DVD, software, video games, cassette tapes, and voice or video recording devices that have been opened.
* Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
* Any item that is returned more than 30 days after delivery

Refunds-
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

 

Late or missing refunds 
If you haven’t received a refund after 14 days, contact your credit card company, it may take some time before your refund is officially posted. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at Rectify-Electronics@cyberservices.com.

 

Sale items-
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

 

Exchanges-
We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at Rectify-Electronics@tech-center.com 

 

Shipping-
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary. If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
